4. Seller Responsibilities

Sellers must:

  • Ensure that all listings are accurate, truthful, and not misleading.

  • Deliver items as described and within the promised timeframe.

  • Comply with all applicable laws and regulations regarding their products and transactions.


5. Prohibited and Restricted Items

The sale of items that are prohibited or restricted on eBay is also prohibited on Marketshopper.online. This includes, but is not limited to:

  • Illegal or stolen goods

  • Weapons, firearms, or explosives

  • Counterfeit items or unauthorized replicas

  • Drugs, drug paraphernalia, or controlled substances

  • Hate materials or items promoting violence

  • Adult content and pornography

  • Animals or animal parts in violation of laws

6. Fees and Payments

Sellers agree to pay any applicable listing and transaction fees, which are subject to change with notice. Buyers agree to pay for all purchased items, including applicable taxes and shipping costs.


7. Disputes and Resolution

Marketshopper.online is not a party to transactions between users. However, we may assist in dispute resolution at our discretion. Users are encouraged to resolve issues directly with each other.


8. Termination

We reserve the right to suspend or terminate accounts, without prior notice, for violations of these Terms or any applicable law.


9. Limitation of Liability

Marketshopper.online is not liable for any direct, indirect, incidental, or consequential damages resulting from your use of the Site. We do not guarantee the quality, safety, or legality of items sold.


10. Modifications

We may update these Terms from time to time. Continued use of the Site constitutes acceptance of any revised terms.


11. Governing Law

These Terms are governed by and construed in accordance with the laws of The State of Arizona and the United States of America, without regard to conflict of law principles.


12. Prohibited Conduct: Hacking, Misinformation & Abuse

You agree not to engage in any activity that compromises the integrity, security, or credibility of Marketshopper.online, including but not limited to:

a. Hacking and Unauthorized Access

  • Attempting to gain unauthorized access to our systems, user accounts, or backend infrastructure.

  • Interfering with the platform’s functionality through viruses, bots, scraping, brute-force attacks, or any form of malicious code or behavior.

  • Circumventing, disabling, or otherwise interfering with security features or system limitations.

b. Spreading Misinformation

  • Posting or transmitting false, misleading, or deceptive content in listings, reviews, support messages, or seller information.

  • Impersonating individuals, businesses, or representatives of Marketshopper.online.

  • Fabricating sales history, product claims, or buyer feedback.

c. Platform Abuse

  • Using the site to commit fraud or manipulate transactions (e.g., fake purchases, false reviews).

  • Harassing, threatening, or exploiting other users.

  • Attempting to disrupt the reputation, services, or operations of Marketshopper.online.

Violations of this section may result in immediate account suspension, removal of listings, legal action, and permanent banning from the platform.

Buyer Agreement

Marketshopper.online

This Buyer Agreement (“Agreement”) governs your purchase and use of products and services on Marketshopper.online (“we,” “our,” or “Marketplace”). By purchasing items from the site, you (“Buyer,” “you,” or “your”) agree to be bound by this Agreement, in addition to our general Terms and Conditions and Return & Refund Policy.


1. Buyer Eligibility

To use Marketshopper.online as a buyer, you must:

  • Be at least 18 years old or the age of majority in your jurisdiction.

  • Provide accurate contact and payment information.

  • Not be prohibited from making purchases under applicable laws.


2. Buyer Responsibilities

As a buyer on Marketshopper.online, you agree to:

  • Only purchase items with the intent to pay and receive delivery.

  • Review product descriptions and seller policies before purchasing.

  • Pay all applicable costs, including item price, shipping, taxes, and fees.

  • Contact the seller first in case of issues before filing a complaint with the platform.

  • Avoid abusive behavior, fraudulent claims, or false chargebacks.


3. Order and Payment Process

  • When you place an order, you enter into a direct agreement with the seller.

  • Payments are processed securely via third-party providers (e.g., Stripe, PayPal).

  • Marketshopper.online may hold funds temporarily for fraud prevention, dispute resolution, or quality control.


4. Returns and Refunds

  • Buyers are protected by our Return & Refund Policy.

  • You must submit any return/refund requests within the applicable timeframes (typically within 7 days of receiving the item).

  • If returning, items must be in the original condition unless damaged or defective.

  • You may be responsible for return shipping unless the seller is at fault.

  • Abuse of the return/refund system may lead to account restrictions.


5. Prohibited Buyer Conduct

Buyers must not:

  • Attempt to deceive or defraud sellers or the platform.

  • Purchase restricted items (refer to our Prohibited Items Policy, aligned with eBay’s Restricted Items List).

  • Harass or threaten sellers.

  • Use false information or stolen payment methods.

Violation may result in cancellation of orders, suspension of your account, and legal action where appropriate.


6. Disputes and Platform Mediation

  • In the event of a dispute, you agree to first communicate with the seller directly.

  • If unresolved, you may escalate the issue to Marketshopper.online within 3 days after the seller's last response.

  • We will review the case and make a final decision, which may include a refund, replacement, or denial of the claim.


7. Buyer Protection Limitations

While we strive to protect all users, Marketshopper.online is not liable for:

  • The actions of individual sellers.

  • Lost or damaged shipments where the carrier is at fault and no insurance was purchased.

  • Delays due to incorrect address information or buyer inaction.


8. Privacy and Data Use

  • Your data will be used in accordance with our Privacy Policy.

  • We do not sell or misuse buyer data.

  • Marketplace communication may be monitored for safety and compliance.


9. Termination of Access

We may restrict or terminate your access if:

  • You violate this Agreement or our Terms and Conditions.

  • You engage in fraud, abuse, or repeat return claims.

  • You misuse the platform or interfere with other users.


10. Modifications

We may update this Buyer Agreement periodically. Notice will be provided for major changes. Continued use of the platform constitutes acceptance of any revised terms.

 

Seller Agreement

This Seller Agreement (“Agreement”) is entered into by and between Marketshopper.online (“we,” “us,” or “Marketplace”) and you (“Seller,” “you,” or “your”), governing your use of the Marketshopper.online platform for selling goods and services.

By registering as a seller, listing products, or using any of our services, you agree to the terms of this Agreement.


1. Eligibility and Account Registration

To become a seller:

  • You must be at least 18 years of age.

  • You must provide accurate and complete registration information.

  • You are solely responsible for maintaining the confidentiality and security of your account.


2. Seller Obligations

As a seller on Marketshopper.online, you agree to:

  • Only list items that are legal to sell and not restricted under applicable laws.

  • Accurately describe all items and ensure that listings are truthful and not misleading.

  • Fulfill all orders in a timely and professional manner.

  • Comply with all applicable tax laws and regulations.

  • Maintain up-to-date contact and payment information on your account.


3. Prohibited and Restricted Items

You must not list, sell, or offer any item that is:

  • Prohibited or restricted by Marketshopper.online, which includes but is not limited to items that are:

    • Illegal or counterfeit

    • Stolen or unauthorized

    • Firearms, explosives, or weapons

    • Controlled substances or drug paraphernalia

    • Hazardous or unsafe items

    • Items promoting hate, violence, or illegal activity

Important:
Marketshopper.online adopts the same restricted and prohibited item policies as eBay. Any item prohibited or restricted on eBay’s policy list is also prohibited on our platform.

We reserve the right to remove any listing that violates this rule and to suspend or terminate your account without notice.


4. Fees and Payouts

  • Sellers agree to pay applicable listing, transaction, and commission fees as specified in our Fees Schedule [link or section to be created].

  • Marketshopper.online will process payments on behalf of the seller and transfer proceeds (less applicable fees) to the seller’s designated payout method.

  • Payouts are typically made [insert payment schedule, e.g., weekly or after order delivery], subject to delays for fraud prevention or dispute resolution.


5. Shipping and Fulfillment

  • You are responsible for packaging and shipping sold items to buyers.

  • Items must be shipped in accordance with the shipping timeline you specify in the listing.

  • You must provide valid tracking information upon shipment when applicable.

  • Failure to fulfill orders may result in cancellation, negative reviews, or account suspension.


6. Returns and Disputes

  • You must clearly state your return/refund policy.

  • You agree to cooperate with Marketshopper.online in resolving disputes between you and buyers.

  • In cases of non-delivery, item not as described, or fraud, Marketshopper.online may refund the buyer and recover funds from the seller.


7. Termination of Seller Privileges

Marketshopper.online may, in its sole discretion:

  • Suspend or terminate your account for any violation of this Agreement or our Terms and Conditions.

  • Remove listings or withhold payments if fraud, misconduct, or policy violations are suspected.


8. Intellectual Property

  • You grant Marketshopper.online a non-exclusive, worldwide license to use your product listings, photos, descriptions, and branding for marketing and platform purposes.

  • You affirm that you have rights to all content you post.


9. Limitation of Liability

Marketshopper.online is not liable for:

  • Any loss or damage related to your use of the platform

  • Lost profits, data, or business opportunities

  • Third-party actions, including those of buyers


10. Amendments

We reserve the right to update this Agreement at any time. You will be notified of significant changes. Continued use of the platform after updates constitutes your acceptance.

 

Seller Verification Policy

At Marketshopper.online, the trust and safety of our buyers and sellers is our top priority. To maintain a secure marketplace, we may require business and identity verification documents before approving or maintaining a seller account.


1. Verification Requirement

  • All sellers must provide accurate and truthful information during account registration.

  • Marketshopper.online may request additional documentation to verify your business or identity before an account is approved.

  • Failure to provide the requested documents may result in delayed approval or denial of your seller account.


2. Types of Documents We May Request

Depending on your business structure and location, verification may include:

  • Government-issued photo ID (passport, driver’s license, national ID)

  • Business registration certificate or license

  • Tax identification number (TIN, VAT, EIN, etc.)

  • Proof of address (utility bill, lease, or bank statement)

  • Other documentation as reasonably required for compliance


3. Ongoing Verification & Updates

  • Sellers are required to keep their business and contact information up to date.

  • If there are any changes to your business details (such as ownership, legal entity name, or banking details), you must submit updated documents to Marketshopper.online immediately.

  • Accounts may be suspended or limited if updated information is not provided when requested.


4. Data Protection

  • All documents submitted are stored securely and used solely for verification and compliance purposes.

  • We will never sell or share your verification documents with third parties, except as required by law or payment processing partners.


5. Consequences of Non-Compliance

Marketshopper.online reserves the right to:

  • Suspend or deny account approval if documents are not provided

  • Freeze payouts until verification is complete

  • Permanently close accounts providing false or fraudulent documentation

Fees & Commission Schedule

This schedule outlines the current fees and commissions applicable to sellers on Marketshopper.online. By selling on our platform, you agree to these charges.

3. Payment Processing Fees

4. Payout Schedule

  • Payouts are processed when completion of the delivery has been made to the buyer
    Delivery confirmations are completed daily at 6:00AM MST ARIZONA for deliveries made the previous day.

  • Minimum payout threshold: $1

  • Payouts below $1 will be held until the threshold is met.

  • Payout methods include: PayPal

We reserve the right to update our fee structure. Notice will be provided at least 1 days prior to any fee changes.

 

Return & Refund Policy
Marketshopper.online

At Marketshopper.online, we strive to create a safe and trustworthy marketplace for both buyers and sellers. This Return & Refund Policy outlines how returns, exchanges, and refunds are handled.


1. General Return Policy

Buyers may request a return or refund under the following conditions:

  • The item was not received.

  • The item does not match the description.

  • The item was damaged during shipping.

  • The item is defective or non-functional.

  • The seller offers returns for other reasons (e.g., buyer’s remorse), which must be clearly stated in the item listing.

  • Accept returns and issue full or partial refunds if the buyer’s claim is valid (e.g., item not as described, damaged, etc.).

  • Provide a return shipping label if the seller is at fault.


4. Buyer Responsibilities

Buyers must:

  • Submit photo or video evidence if an item is defective, damaged, or incorrect.

  • Return items in their original packaging and condition (unless the item was defective or damaged).

  • Ship the return using a trackable shipping method (if return is buyer’s responsibility).


5. Refund Process

  • Once the returned item is received and approved by the seller, a refund will be issued within 5 business days.

  • Refunds are made to the original payment method.

  • If the seller does not respond, Marketshopper.online may step in to mediate the case and issue a refund on the seller’s behalf (deducted from seller’s payout).


6. Non-Returnable Items

The following items are non-returnable, unless they arrive damaged or not as described:

  • Perishable goods (e.g., food, flowers)

  • Custom-made or personalized items

  • Digital goods or downloadable products

  • Health & hygiene products (e.g., cosmetics, intimate items)


7. Dispute Resolution

If the buyer and seller cannot agree:

  • The buyer may escalate the case to Marketshopper.online within 3 days of the seller’s last response.

  • We will review evidence from both parties and make a final decision.

  • Chargebacks or fraudulent claims may result in account suspension.

Buyer Agreement – Digital Products

This Buyer Agreement ("Agreement") applies specifically to purchases of digital products (e.g., software, eBooks, music, templates, online services, etc.) on Marketshopper.online (“we,” “us,” or “Marketplace”). By purchasing digital content on our platform, you (“Buyer,” “you,” or “your”) agree to the following terms:


1. Nature of Digital Products

Digital products sold on Marketshopper.online may include:

  • Downloadable files (e.g., PDFs, audio, video, software)

  • Access keys, licenses, or codes

  • Access to services or content hosted online (e.g., courses or cloud-based tools)

Digital purchases are non-physical and delivered electronically.


2. Delivery and Access

  • Digital products are typically available immediately after payment confirmation, unless otherwise noted.

  • Access links or files will be provided through your user account, email, or direct download.

  • You are responsible for downloading and backing up your files. Access is not guaranteed indefinitely.


3. License and Usage Rights

Unless otherwise stated by the seller:

  • Purchases grant you a non-exclusive, non-transferable license to use the digital content for personal use only.

  • You may not resell, redistribute, reproduce, or share the content without written permission from the seller.

  • Some digital products may be governed by additional licensing terms disclosed in the product description or accompanying documentation.


4. Refund Policy for Digital Products

All digital product sales are final, and no refunds will be issued unless:

  • The product is not delivered after payment and you notify us within 3 business days.

  • The product is defective or corrupt, and the issue cannot be resolved by the seller within 5 business days.

  • The product is significantly misrepresented (e.g., features or format do not match the listing).

Refund requests must include proof (e.g., screenshots, file errors, seller messages) and must be submitted via support@marketshopper.online.


5. Prohibited Conduct

You agree not to:

  • Attempt to reverse-engineer, extract, or manipulate digital content.

  • Circumvent digital rights management (DRM) or security measures.

  • Share access credentials or product files with unauthorized third parties.

  • Abuse the refund system or file false claims.

Violations may lead to account suspension, removal from the platform, and legal action.


6. Support and Disputes

  • Sellers are responsible for offering basic technical or usage support if advertised.

  • If a seller fails to respond within 3 business days regarding a valid issue, you may escalate the case to Marketshopper.online.

  • We reserve the right to make a final determination based on provided evidence.


7. Limitation of Liability

Marketshopper.online is not responsible for:

  • Compatibility issues (unless clearly stated in the listing)

  • Your inability to access a product due to outdated software, hardware, or user error

  • Any damages arising from use or misuse of a digital product

All purchases are made at your own risk unless otherwise guaranteed by the seller.


 

Seller-Side Digital Product Licensing Agreement

This Digital Product Licensing Agreement (“Agreement”) is made between you (“Seller,” “you,” or “your”) and Marketshopper.online (“Marketplace,” “we,” or “us”). By listing and selling digital products on Marketshopper.online, you agree to be bound by the terms set forth herein.


1. Definitions

  • Digital Product: Any non-physical product delivered electronically, including but not limited to software, eBooks, audio, video, graphics, templates, codes, licenses, or access to online services.

  • Buyer: The purchaser of your digital product through Marketshopper.online.

  • License: The usage rights granted to Buyers by you through your digital product listings.


2. Grant of License to Buyer

By listing a digital product on Marketshopper.online, you grant the Buyer a non-exclusive, non-transferable license to use the digital product solely for the purposes and under the terms you specify in your product listing.

Unless explicitly stated otherwise in your listing or accompanying license, Buyers are granted a license for personal, non-commercial use only.


3. Seller Obligations

You agree to:

  • Provide Accurate Descriptions: Clearly disclose the nature, features, format, compatibility, and licensing terms of the digital product in your listing.

  • Deliver Promptly: Ensure the digital product or access credentials are delivered electronically immediately or within the timeframe stated after payment confirmation.

  • Offer Support: Respond promptly to reasonable Buyer inquiries or issues related to product access or usability, typically within 3 business days.

  • Honor Refunds: Comply with Marketshopper.online’s Return & Refund Policy for digital products, providing refunds or exchanges as applicable.

  • Respect Intellectual Property Laws: Only list digital products you own or have rights to sell. Do not infringe on third-party copyrights, trademarks, or other intellectual property rights.


4. Restrictions on Seller

You must not:

  • List products that contain illegal content, malware, spyware, or viruses.

  • Misrepresent the product, including its features, quality, or licensing terms.

  • Facilitate unauthorized distribution or resale of digital products.

  • Circumvent any digital rights management (DRM) technology or security measures.


5. Intellectual Property Rights

You retain all intellectual property rights in the digital products you sell unless you explicitly transfer rights to Buyers in your license terms. You represent and warrant that you have all necessary rights and permissions to license and sell the digital products on Marketshopper.online.


6. Liability and Indemnification

  • You are responsible for the accuracy, legality, and quality of the digital products you offer.

  • You agree to indemnify, defend, and hold harmless Marketshopper.online from and against any claims, losses, damages, liabilities, costs, and expenses arising from your digital product listings or violations of this Agreement.

  • Marketshopper.online is not liable for any damages, losses, or disputes arising from Buyer use of your digital products.


7. Termination

Marketshopper.online reserves the right to suspend or terminate your seller account, remove your listings, or take other actions if you violate this Agreement, applicable laws, or Marketplace policies.


8. Governing Law and Dispute Resolution

This Agreement is governed by the laws of [Insert Jurisdiction]. Any disputes will be resolved through binding arbitration or in a court of competent jurisdiction within [Insert Jurisdiction].


9. Amendments
